Bill Cosby's lawyers say accuser Andrea Constand is a 'con artist'

Andrea Constand Testifies Agreeing to $3.38M Settlement With Cosby Because She 'Just Wanted It Over'

The jurors in Bill Cosby's sexual assault retrial heard transcripts from a 2005 interview with Bill police after Andrea Constand reported the actor for drugging and molesting her.

Constand testified Friday that she drank wine and took three blue pills at Cosby's urging in January 2004, then lost consciousness and, sometime later, was "jolted awake" to find the entertainer sexually assaulting her. "I was thinking how wrong it was".

At the retrial, Cosby's new lawyer, Tom Mesereau, has called Constand a "con artist" who baited Cosby by feigning romantic interest in him and wound up with a $3.4 million civil settlement after she leveled a false claim of sexual molestation.

According to Constand, a former Temple University employee, Cosby acted as her mentor and gained her trust prior to assaulting her in 2004.

Under cross-examination from Mr. Cosby's lead attorney, Thomas A. Mesereau Jr., the local investigator, Sgt. Richard Schaffer, denied that Ms. Constand had been inconsistent in her stories about the timing of the encounter, how much alcohol she had drunk on that occasion and whether she had a flirtatious relationship with Mr. Cosby.

Constand testified that she felt a duty to answer Cosby's inquiries because he was a powerful alumnus and trustee. Jackson has said that she and Constand worked closely together, had been friends and had shared hotel rooms several times.

The 80-year-old also testified in the deposition that he didn't think Constand had come forward to collect a big payday.

In the first week of Cosby's retrial, a topless protester launched herself at him, with the names of the accusers painted across her body. He said Constand never told him to stop and was conscious throughout.

But Mesereau, who's best known for winning Michael Jackson an acquittal in his 2005 child molestation case, was incredulous as Constand denied being aware that Cosby was sexually attracted to her - even after he touched her thigh on one occasion and tried unbuttoning her trousers on another.

The mother began crying on the stand when asked how she knew what Cosby allegedly did to her daughter. She took it and soon became woozy and "slightly out of it".

"We were talking about sleep, and her stress", Cosby told cops in 2005, going on to agree when cops asked if he'd handed her the pills to relax her. "His robe opened up".

She testified that she had gotten to know Cosby when she was operations manager for Temple University's womens' basketball team.

The District Attorney's office continued with its strategy to draw parallels between the allegations of Cosby's other accusers, who testified last week, and Constand's.

In the testimony, Cosby admitted under oath that he obtained a prescription for the now-illegal drug in the 1970s and gave it to women he wanted to have sex with.

Dickinson said she went along because she needed the money - and feared Cosby would ruin her career. It was written by ghostwriters. "And I don't feel her say anything", he said in the deposition.

Also testifying for the prosecution was James Reape, a detective with Montgomery County, who acknowledged that Ms. Constand had provided conflicting time frames.

"I didn't feel like it", Schaffer quoted Cosby as saying in the interview. These could send him to prison for years.

Judge Steven O'Neill ruled Tuesday that prosecutors can read the testimony into the record at Cosby's retrial on charges he drugged and molested Andrea Constand at his suburban Philadelphia mansion in 2004.

"Not a knock out drug, an over-the-counter drug you could buy at your local drug store right now", said Andrew Wyatt, spokesman for Cosby.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand and the other women have done.
