Harvey Weinstein recent rape allegations are 'credible,' NYPD says, as evidence is gathered for possible arrest warrant

Speaking at a news conference at Police Headquarters in Lower Manhattan on Friday afternoon, officials told The New York Times they were gathering evidence with an eye toward preparing a warrant to arrest Weinstein, whose representatives have said is undergoing therapy outside of New York.

The NYPD and Manhattan district attorney's office are both investigating allegations made by the "Boardwalk Empire" actress.

Speaking to Vanity Fair, De Le Huerta said that Weinstein insisted on having a drink at her apartment in NY after offering her a ride home from a hotel in October 2010.


When they arrived at her apartment, the actress said he demanded to go inside for a drink.

"I did say no, and when he was on top of me I said, 'I don't want to do this, '" de la Huerta told Vanity Fair. Just before Christmas that year, she alleges, he showed up in the lobby of her apartment building.

Dozens of women have accused the former movie star producer of sex assault.


"Immediately when we got inside the house, he started to kiss me and I kind of brushed [him] away", de la Huerta told the mag. "We are actively investigating them", Sergeant Brendan Ryan, an NYPD spokesman said Thursday. "But we're talking about a 7-year-old case". She had been drinking and was not in a condition to give consent, CBS reported the actress said.

The first instance, de la Huerta said, was in November of that year. A Weinstein spokesperson has "unequivocally denied" any accusations of non-consensual sex.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they speak publicly, which de la Huerta and Guiterrez have done. "The investigation is on-going". "As this is an active investigation, we will not be commenting further".
